Awaiting legal review. This document is a draft and is not final. Remove this box once a qualified legal advisor has signed it off.
These Terms govern your use of WattDrive’s EV charging network, the GoWattDrive app and the website wattdrive.in. They set out the rules of using our service. How we handle your personal data is in the Privacy Policy, and refunds and cancellations are in the Refund and Cancellation Policy. Each is a separate document.
1. Acceptance and definitions
By creating an account, scanning a charger’s QR code, starting a session or using the app or website, you agree to these Terms. If you do not agree, do not use the service.
- “WattDrive”, “we”, “us”: WattDrive Infra Private Limited (CIN U35105UW2026PTC255942), AltF Noida 142, Plot No. 21 & 21A, Sector 142, Maharishi Nagar, Noida, Gautam Buddha Nagar, Uttar Pradesh 201305.
- “You”: any person who uses the service.
- “Charger”: any EV charging equipment operated by WattDrive, including AC and DC units at public, residential, commercial and hospitality sites.
- “Host”: the owner or manager of the premises where a Charger is installed, such as a housing society, hotel or business.
- “Session”: one period of charging, from start to stop.
- “Service”: the Chargers, the app, the website and related support.
Eligibility. You must be at least 18, legally able to contract under Indian law, and hold a valid driving licence and registration for any vehicle you charge. Where you use the Service for a business or fleet, you confirm you are authorised to bind that business.
2. Your account
- Register with accurate mobile number, name and email, and keep them current. Verification is by one-time password.
- You are responsible for all Sessions started from your account, so keep your login and any RFID card or app access secure. Tell us at once if you suspect misuse.
- One person, one account. Do not share or sell accounts, wallet balances or RFID cards.
- Some Chargers at residential societies are open only to residents or approved vehicles. You must follow the Host’s access rules.
- You may close your account at any time from the app or by writing to us. Closure does not cancel amounts you owe. See our Account Deletion Policy.
3. Using the chargers
Safety first. You use a Charger at your own risk and must:
- Check that your vehicle, charging port and cable are compatible with the Charger and in good working order, and follow your vehicle manufacturer’s charging guidance.
- Use only the connectors and cables provided or approved for your vehicle. Never modify, force or tamper with a Charger, cable or enclosure.
- Not charge in rain flooding, with a damaged connector, or with exposed or burnt wiring. Stop and report any smoke, sparking, burning smell or unusual noise, and move away.
- Park only in the marked charging bay, and move your vehicle promptly when the Session ends.
- Not leave children or animals unattended near a Charger.
Charging speed. Actual power depends on your vehicle’s battery, temperature, state of charge, the site’s available load and the Charger’s rating. Charging time and range shown in the app are estimates, not guarantees.
Idle and overstay. Where a site displays idle or overstay fees, they apply after the stated grace period so that bays stay available for others.
Prohibited conduct. You must not:
- Use the Service for unlawful purposes or to charge a vehicle you are not entitled to use.
- Damage, block or vandalise Chargers, or remove signage.
- Bypass payment, reverse-engineer the app, scrape data, or interfere with the network or its security.
- Use a Charger to supply power to anything other than an electric vehicle.
4. Tariffs, wallet and payments
- Tariffs. The price per kWh, any session, idle or overstay fee and applicable GST are shown on the Charger or in the app before you start. The price shown when you start a Session is the price you pay for that Session. Tariffs vary by site and may change for future Sessions.
- Billing. You pay for energy delivered as measured by the Charger’s meter, plus applicable taxes and fees. We issue an invoice or receipt in the app.
- Payment methods. UPI, cards, net banking and wallet, processed by third-party payment gateways. Their terms also apply, and we never see or store your full card details or UPI PIN.
- Wallet. Wallet balance is prepaid credit for charging only. It is not a bank account or deposit, earns no interest, is non-transferable, and cannot be used for anything other than WattDrive charging.
- Failed or disputed charges. If you are charged and the Session did not deliver energy, or you believe a charge is wrong, write to us within 7 days with the transaction ID. Refunds, reversals and cancellations are handled solely under the Refund and Cancellation Policy.
- Non-payment. We may block access, set off wallet balance, and recover unpaid amounts, including through lawful collection.
5. Availability, liability and suspension
Availability. We work to keep Chargers and the app running, but we do not guarantee uninterrupted or error-free service. Chargers may be unavailable for maintenance, power cuts, grid or network faults, Host decisions or events beyond our control. Listings, maps and live availability are indicative.
No warranty. The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including fitness for a particular vehicle or purpose.
Limits on our liability. To the extent permitted by law:
- We are not liable for indirect, incidental or consequential loss, loss of profit or time, or damage arising from vehicle incompatibility, battery or charging-system faults, grid voltage fluctuations or your breach of these Terms.
- We are not liable for theft of or damage to your vehicle or belongings at a site, which remain the responsibility of you and the Host, except where caused by our negligence.
- Our total liability to you for any claim relating to a Session is limited to the amount you paid for that Session, or Rs 5,000, whichever is higher.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, fraud, or your rights under the Consumer Protection Act, 2019.
Indemnity. You will compensate us for loss, claims and costs caused by your breach of these Terms, misuse of a Charger, or unlawful use of the Service.
Suspension and termination. We may suspend or end your access immediately, with notice where practicable, if you breach these Terms, create a safety risk, commit fraud or misuse, or if required by law. We may also withdraw or change any Charger, feature or site at any time.
Force majeure. We are not responsible for failure or delay caused by events beyond reasonable control, such as natural disaster, fire, flood, grid failure, strike, epidemic, war or government action.
6. Intellectual property, disputes and general terms
Intellectual property. The WattDrive and GoWattDrive names, logos, app, website, software and content belong to WattDrive or its licensors. We grant you a limited, revocable, non-transferable licence to use the app for personal charging. You may not copy, modify, resell or reverse-engineer any part of it.
Feedback. If you send suggestions, we may use them without obligation to you.
Third-party services. The app may link to maps, payment gateways and other services we do not control. Their terms apply and we are not responsible for them.
Governing law and disputes. These Terms are governed by the laws of India. Please first write to us at the address below, and we will try to resolve the matter within 30 days. If unresolved, the courts at Gautam Buddha Nagar (Noida), Uttar Pradesh have exclusive jurisdiction, without limiting any right you have as a consumer to approach a consumer forum. [Counsel to confirm whether to add arbitration for business and fleet users.]
Changes. We may update these Terms. We will post the new version on the website and app with a new “Last updated” date, and tell you of material changes. Continued use after that means you accept them.
General. If any term is unenforceable, the rest continue. Our failure to enforce a term is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor. These Terms, with the Privacy Policy and Refund and Cancellation Policy, are the whole agreement between you and WattDrive for the Service. Host, franchise and fleet customers are additionally governed by their signed agreements, which prevail on conflict.
